These Terms and Conditions (“Terms”) govern your use of prolawnpower.com and purchases from PROLAWN POWER EQUIPMENT LLC (“ProLawn Power,” “we,” “us,” or “our”). By using the site or placing an order, you agree to these Terms and our incorporated Privacy Policy, Order Fulfillment Options, and Product Returns policy. If you do not agree, do not use the site.
1. Eligibility and Accounts
You must be legally able to enter a binding agreement. You are responsible for accurate information, safeguarding account credentials, and activity under your account. Notify us promptly of suspected unauthorized use.
2. Website Information
We try to present accurate descriptions, images, compatibility information, availability, and prices. Colors and dimensions may vary by display, manufacturing tolerance, or packaging. Product specifications and availability may change without notice. Confirm that a product is suitable and lawful for your intended use.
3. Prices, Taxes, and Errors
Prices are shown in U.S. dollars unless stated otherwise and exclude applicable tax, shipping, handling, and other charges until calculated. We may correct typographical, pricing, inventory, or technical errors and may cancel or adjust an affected order, even after an acknowledgment. If payment was captured for a canceled item, the applicable amount will be refunded.
4. Orders and Acceptance
Your order is an offer to purchase. An automated acknowledgment is not acceptance. We may limit quantities, request verification, reject or cancel orders, or restrict sales to resellers, suspected fraud, pricing errors, unavailable products, or prohibited destinations. Acceptance occurs when we confirm shipment or otherwise expressly accept the order.
5. Payment
You authorize us and our payment providers to charge the amounts shown at checkout using the selected method. You represent that you are authorized to use that method. Available payment methods are those displayed at checkout. Orders may be held until payment and fraud checks are complete.
6. Shipping, Fulfillment, and Delivery
ProLawn Power offers free standard shipping for eligible orders to all 50 United States. Orders normally require 3–5 business days for handling and 3–8 business days in carrier transit, for an estimated total of 6–13 business days. Orders may ship from Texas or third-party U.S. supplier warehouses. Complete terms are provided in our Shipping and Order Fulfillment Policy. Delivery dates are estimates rather than guarantees. Nothing here limits rights that cannot lawfully be waived.
7. Returns and Warranties
Returns are governed by our Product Returns policy. Manufacturer warranties, if any, are provided by the manufacturer under its terms. ProLawn Power does not expand a manufacturer warranty unless we expressly agree in writing.
8. Safe and Lawful Product Use
Tools and equipment can cause injury or property damage. Read and follow all manuals, warnings, personal-protective-equipment requirements, maintenance instructions, and applicable laws. Use products only for their intended purpose and with compatible accessories. Installation or operation by a qualified person may be required.
9. Intellectual Property
The site’s ProLawn Power branding, design, text, graphics, software, and other content are owned by or licensed to ProLawn Power and protected by law. Product names and third-party trademarks belong to their respective owners. You may use the site for personal, lawful shopping and information purposes only. You may not copy, scrape, republish, sell, reverse engineer, or exploit site content without permission.
10. Reviews and Submissions
If you submit reviews, photos, feedback, or other content, you represent that it is accurate, lawful, and yours to share. You grant ProLawn Power a nonexclusive, worldwide, royalty-free license to host, reproduce, adapt, publish, and display it for operating and promoting our services. We may moderate or remove submissions but are not required to do so.
11. Prohibited Conduct
You may not misuse the site; interfere with security or operation; introduce malicious code; impersonate others; collect data without authorization; violate law or third-party rights; conduct fraudulent transactions; or use automated systems in a way that burdens the service.
12. Third-Party Services and Links
Third-party websites, carriers, manufacturers, payment services, and embedded tools operate under their own terms and policies. We are not responsible for third-party services outside our control.
13. Disclaimer
To the maximum extent permitted by law, the site and its content are provided “as is” and “as available.” ProLawn Power disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation, except where a warranty cannot legally be excluded.
14. Limitation of Liability
To the maximum extent permitted by law, ProLawn Power and its members, managers, employees, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost data, or business interruption arising from the site or products. Our aggregate liability for a claim will not exceed the amount you paid to ProLawn Power for the product or transaction giving rise to the claim. These limits do not apply where prohibited by law.
15. Indemnification
To the extent permitted by law, you agree to defend and indemnify ProLawn Power from claims and expenses resulting from your unlawful misuse of the site, violation of these Terms, or infringement of another person’s rights.
16. Governing Law and Venue
These Terms are governed by Texas law, without regard to conflict-of-law rules. Subject to consumer rights that require another forum, courts located in Harris County, Texas will have exclusive jurisdiction over disputes arising from these Terms or the services.
17. General Terms
If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with our business. These Terms and incorporated policies are the entire agreement concerning the covered subject matter.
18. Changes
We may update these Terms by posting a revised version and effective date. Continued use after the update means you accept the revised Terms to the extent permitted by law.
